Understanding the trend

What is this trend?

ALPR surveillance litigation is surging as Flock's expansion beyond police departments onto private property collides with California's ALPR-specific statute and the federal Driver's Privacy Protection Act. Filings now span ALPR-vendor suits (Reyes v. Motorola) and a fast-growing parking/DPPA "payment-notice" cluster where operators use plate captures to pull DMV addresses and mail private charges. A coordinated plaintiff-firm investigation campaign is mapping every property running Flock or Motorola cameras.

What caused it

Flock Safety's aggressive expansion from police departments into private property (retailers, HOAs, parking facilities) brought its plate-scan-and-share architecture into direct conflict with California's ALPR-specific statute (SB 34) and the federal DPPA. A parallel litigation wave emerged when parking operators began using ALPR plate captures to pull DMV registered-owner addresses and mail private payment-demand notices, triggering DPPA per-violation damages at $2,500–$5,000 plus attorneys' fees.

Practices driving the lawsuits

  • Deploying ALPR cameras to scan, record, and share license plate data without owner consent under California Civil Code §1798.90 (SB 34)
  • Using plate scans to query DMV records for registered-owner addresses and mailing commercial payment demands under DPPA
  • Sharing or selling plate-read data to third parties without owner knowledge or consent
  • Operating ALPR networks that upload scans to centralized cloud databases for law-enforcement and private-operator access
