What is this trend?
Right of publicity claims challenge the commercial use of a person’s identity—name, face, voice, likeness, or persona—without consent. The expanded record shows the theory operating across six connected lanes: identity-as-advertising, athlete NIL compensation, biometric faceprints, synthetic voice and digital twins, creator-content AI training, and conventional endorsement or merchandising disputes.
What caused it
The common fact pattern is identity becoming an input to a product or revenue funnel. People-search platforms display named profiles to sell access; leagues and media businesses monetize athlete identity; camera products create face libraries from bystanders; AI vendors generate voices, avatars, and other replicas; and platforms train models on creator content that contains recognizable names, faces, voices, and personas. These newer fact patterns therefore sit inside a larger shift from “did an ad use my image?” to “who controls, licenses, and profits from identity data and derived outputs?”
