What is this trend?
A fast-moving wave of copyright and DMCA litigation targeting how generative-AI companies acquire and use copyrighted material. Plaintiffs — book authors, news publishers, music labels, visual artists, and rightsholders — allege that AI developers scraped, downloaded, or ingested their protected works (often from pirated 'shadow library' datasets like Books3) to train large language and diffusion models without permission, license, or attribution.
What caused it
The 2022–23 public launch of ChatGPT, Stable Diffusion, and similar models exposed that frontier systems were trained on massive web-scraped and pirated corpora. As model capabilities (and revenues) climbed, rightsholders moved from cease-and-desist to coordinated class and individual actions, asserting direct infringement for the copying inherent in training and DMCA §1202 claims for stripped copyright-management information. The September 2025 Anthropic class settlement (~$1.5B, recognized by the court) signaled that these theories can survive and resolve at scale.
