A fast-moving wave of copyright and DMCA litigation targeting how generative-AI companies acquire and use copyrighted material to train their models. Plaintiffs allege developers scraped or ingested protected works — often from pirated datasets — without permission, license, or attribution. The September 2025 Anthropic class settlement (~$1.5B) signaled these theories can survive and resolve at scale.
What caused it
Generative-AI companies' rapid scaling required massive training corpora. Developers ingested copyrighted books, articles, code, images, and music — often from pirated 'shadow library' datasets (Books3, LibGen) — without licenses or attribution. The September 2025 Anthropic class settlement (~$1.5B) demonstrated these claims survive Twombly and can resolve at scale, accelerating copycat filings by authors, artists, publishers, and music rights holders.
Practices driving the lawsuits
- Scraping or ingesting copyrighted text, code, images, and audio without a license to train large language models and diffusion models
- Using DMCA-circumventing tools to remove copyright management information (CMI) from training data
